Prior Acts & Tail Coverage

Prior acts coverage is needed to cover any claims that may arise subsequent to becoming a UMIA insured from medicine practiced within the UMIA coverage area while insured with another carrier. Prior acts cannot be extended to physicians who have practiced in states outside the UMIA coverage area (Utah, Idaho, Wyoming, and Montana). Physicians not eligible for prior acts coverage must purchase tail coverage from their prior insurance carrier to provide protection for these types of claims. This coverage is also not extended to physicians with prior claim histories and significant losses.

Tail coverage must be purchased by UMIA physicians who continue to practice medicine if they:

  • Do not meet criteria for tail coverage under DDR portion of the policy
  • Continue to practice medicine in a new location and purchase liability coverage from a carrier who does not provide coverage in prior practice location
  • Continue to practice medicine in same location with coverage from a new carrier who will not write prior acts coverage.

Tail Coverage: Additional insurance to cover any claims that may arise after termination of a claims-made policy from a physician’s treatment or failure to treat a patient during the policy term.

Prior-Acts Coverage: Additional insurance to cover any claims that may arise before the effective date of coverage of a claims-made policy arising from a physician's
treatment or failure to treat a patient.
